5 Tips for Public Figures and their Spouses in Divorce

By | Published On: March 6, 2023

For a public figure getting divorced, concerns such as privacy, security and reputation add an additional layer of complexity to an already challenging process. Here are five tips to help you navigate the process and come to a resolution with your reputation intact and your future secured.

1. Protect Your Privacy

Court proceedings are generally public, although there are steps that can be taken to keep certain information confidential or shielded from public view. However, resolving matters in an out of Court process – such as Mediation, Collaborative Law or Negotiations – is often a better way to ensure that a family’s private information is kept confidential.

2. Handle Complex Finances with Careful Consideration

Public figures may have complex financial portfolios that need to be identified, evaluated, and divided during a divorce, including investments, pensions, intellectual property rights, complex streams of income and assets located in multiple jurisdictions. It is critical to gather information, ask the right questions (and keep asking until you get the answers you need), and develop a clear understanding of the family finances.

3. Protect Your Image and Reputation as a Divorcing Public Figure

A divorce, custody or child support matter can bring unwanted publicity to a public figure and their spouse. Unfortunately, this attention often comes at a time when emotions are raw and a person is already stretched to their limits tending to work, family and legal issues. A family law attorney can advise on the best course of action to protect sensitive information and represent clients in a manner that protects an individual’s image and reputation.

4. Tailor Parenting Arrangements to Your Unique Circumstances

Develop a custody agreement that is tailored to address the unique needs of a public family. For example, if one parent is a politician, a custody agreement may need to address issues such as a minor child’s presence at campaign events or the use of a minor child’s image on social media. Other common issues which may be addressed in a custody agreement include privacy, safety and security concerns, and frequent work travel by one or both parents.

5. Understand Jurisdictional Issues

Jurisdictional issues may arise if Parties are not living in the same location or own property in multiple states. Identify the impacts of jurisdiction on issues such as property division, custody, child support, and the enforcement of Court Orders.
